AMY DIGITAL is committed to protecting your personal data in accordance with Law No. 2017-20 of 20 April 2018 establishing the Digital Code in the Republic of Benin. This policy explains how we collect, use and protect your information.

Data controller

In accordance with article Art. 374 — Digital Code of Benin, the data controller is the natural or legal person who determines the purposes and means of processing personal data.

Data we collect

AMY DIGITAL only collects data that is strictly necessary to provide its services, in accordance with the data minimisation principle set out in Art. 381 — Digital Code of Benin.

a) Data collected directly from you:

  • Identification data: name, first name, company name
  • Contact details: email address, phone number (including WhatsApp)
  • Communication data: content of messages sent via the contact form or WhatsApp
  • Business data: information relating to quotes, orders and payments made
  • Google Ads account data (as part of the recovery service): account identifiers, screenshots of notifications, suspension information

b) Data collected automatically while browsing:

  • Connection data: IP address, browser type and version, operating system
  • Browsing data: pages visited, time spent, referring and exit pages
  • Technical data: screen resolution, browser language, time zone

Data we never collect

AMY DIGITAL never collects sensitive data within the meaning of article Art. 383 — Digital Code of Benin: data relating to ethnic or racial origin, political opinions, religious beliefs, health, sex life or genetic data.

Purposes of processing

In accordance with Art. 379 — Digital Code of Benin, your data is processed for determined, explicit and legitimate purposes. AMY DIGITAL only processes your data for the following purposes:

Customer relationship management
Responding to your contact, quote and service-related requests.
Performing services
Carrying out the assignments ordered: digital marketing, website creation, Google Ads recovery, etc.
Accounting and tax management
Issuing invoices, tracking payments, and complying with Beninese accounting obligations.
Improving our services
Analysing site traffic and improving the user experience using anonymised data.
Marketing communications
Informing you about our new services or offers, only with your prior consent.
Legal obligations
Complying with the legal and regulatory obligations applicable in the Republic of Benin.

Legal basis for processing

Each processing operation carried out by AMY DIGITAL relies on one of the following legal bases, in accordance with Articles 378 to 380 — Digital Code of Benin:

  • Your consent: for marketing communications and the use of non-essential cookies. You may withdraw your consent at any time.
  • Performance of a contract: to process your data as part of carrying out the services you have ordered.
  • AMY DIGITAL's legitimate interest: to improve our services, ensure site security and prevent fraud.
  • Legal obligation: to comply with the accounting, tax and regulatory obligations imposed by Beninese law.

Retention period

In accordance with Art. 386 — Digital Code of Benin, your data is kept only for as long as is strictly necessary for the purposes for which it was collected.

Once these periods expire, your data is deleted or irreversibly anonymised.

Data recipients

AMY DIGITAL never sells, rents or transfers your personal data to third parties for commercial purposes. Your data may nevertheless be shared with the following categories of recipients, strictly within the limits of the defined purposes:

  • Technical providers: host LWS (storage of site data), professional messaging tools — under contracts guaranteeing data confidentiality.
  • Payment providers: KKiaPay for the secure processing of online card payments — subject to their own privacy policies.
  • Communication partners: Meta (WhatsApp Business) for customer exchanges — in compliance with the platform's terms of use.
  • Competent authorities: Beninese tax, judicial or regulatory administrations, in the event of a legal obligation or judicial request.
Contractual commitment

All providers used by AMY DIGITAL are selected for offering sufficient guarantees regarding the implementation of appropriate technical and organisational measures to protect your personal data.

International data transfers

As part of its activities serving clients in France, Europe and the Americas, AMY DIGITAL may need to process the data of individuals residing outside Benin. These transfers are governed in accordance with Articles 396 to 400 — Digital Code of Benin.

AMY DIGITAL ensures that any transfer of data to third countries is carried out in compliance with the following conditions:

  • The recipient country ensures an adequate level of protection for personal data
  • Appropriate contractual guarantees are put in place with the relevant subcontractors
  • Your explicit consent is obtained where the law requires it
Clients residing in Europe (GDPR)

For clients residing in the European Union, AMY DIGITAL undertakes to respect the principles of the General Data Protection Regulation (GDPR — EU Regulation 2016/679) to the extent applicable to our contractual relationships, in particular regarding the lawfulness of processing, data minimisation and the rights of data subjects.

Your rights

In accordance with Articles 389 to 395 — Digital Code of Benin, you have the following rights over your personal data. To exercise any of these rights, send your request to contact@amy-digital.com, specifying your identity.

Right of access

Obtain confirmation that your data is being processed and receive a copy of it, along with information about the conditions of processing.

Right to rectification

Have inaccurate or incomplete data concerning you corrected as soon as possible.

Right to erasure

Request the deletion of your data when it is no longer necessary or when the processing is unlawful, subject to legal retention obligations.

Right to object

Object to the processing of your data for direct marketing purposes or based on AMY DIGITAL's legitimate interest.

Right to restriction

Request the temporary suspension of the processing of your data in the cases provided for by law.

Right to portability

Receive your data in a structured, commonly used and machine-readable format, and transmit it to another data controller.

AMY DIGITAL undertakes to respond to any request to exercise your rights within a maximum of 30 days from receipt of your request.

Withdrawing consent

Where processing is based on your consent, you may withdraw it at any time by sending an email to contact@amy-digital.com. Withdrawing consent does not affect the lawfulness of processing carried out before the withdrawal.

Data security

AMY DIGITAL implements all appropriate technical and organisational measures to ensure the security and confidentiality of your personal data, in accordance with Art. 387 — Digital Code of Benin.

The security measures in place include in particular:

  • Data encryption: communications between your browser and our site are secured via the HTTPS protocol (SSL certificate).
  • Restricted access: only authorised individuals within AMY DIGITAL have access to your data, within the limits of their duties.
  • Secure hosting: your data is hosted with LWS, a certified European host with secure infrastructure in Paris, France.
  • Protection of sensitive files: configuration files and access logs are protected against any unauthorised public access.
  • Regular updates: the software and systems used are kept up to date to fix known security vulnerabilities.

In the event of a data breach likely to create a risk to your rights and freedoms, AMY DIGITAL undertakes to notify the APDP and, where applicable, the individuals concerned, within the timeframes provided for by law.

Minors

The website amy-digital.com and the services offered by AMY DIGITAL are intended exclusively for adults (18 years and older) or for professionals acting within the scope of their work.

AMY DIGITAL does not knowingly collect personal data concerning minors under the age of 18. If you are a parent or legal guardian and believe that your child has provided us with personal data without your consent, please contact us immediately at contact@amy-digital.com so that we can delete it.

Changes to this policy

AMY DIGITAL reserves the right to modify this privacy policy at any time, in particular to adapt it to legislative and regulatory developments, or in response to changes in our data processing practices.

In the event of a substantial change, you will be notified by email (if you have provided us with your address) or by a notice displayed on the amy-digital.com website before the changes take effect.

The version in force is the one displayed on this page, with the date of the last update shown in the header. We encourage you to check this page regularly.

This step does not affect any other legal remedy available to you.
